2018 OPTIMIST INVITATIONAL

1. RULES

a. The race will be governed by the rules as defined by The Racing Rules of Sailing for 2017-2020.

b. The following additional documents govern the regatta: the waiver of liability and consent for medical treatment set forth below.

c. Any changes will appear in full in the sailing instructions.

d.  US Coast Guard approved PFDs are required and shall be worn at all times on the water except as specified in the sailing instructions. Use of inflatable PFDs or buoyancy aids is not permitted. A whistle is recommended. This changes rule 40.

e.  A competitor may not be protested for breaking a class rule that requires membership. An Optimist competitor may not be protested for breaking the IODA requirement for a paddle. This changes rule 60.1.

2. ELIGIBILITY

a. The regatta is open to boats in the Optimist class.

b. Competitors may not reach their 16th birthday in the current calendar year.

3. ENTRY and FEES

a. Registration is in advance by email to staff@egdewoodsailing.org, george.shuster@wilmerhale.com, and gwsjr75@gmail.com.

b. There is no entry fee.

c. Entry is not complete until registration and completion of the waiver of liability and consent for medical treatment set forth below.

4. DIVISIONS and CLASSES

a. There will be a single fleet comprised of all Green, Red, White, and Blue sailors.

b.  Backhalf coaching will be permitted for all sailors.

5. SCHEDULE

1030  Check-in begins at Edgewood Yacht Club, 1 Shaw Avenue, Edgewood, Rhode Island  02905.

1130  Skippers meeting at the mid-marina “T-Dock.”

1200  Marina start.

1230  Warning signal for the 1st race.

1500  No warning for a new race after this time.

 

6. SAILING INSTRUCTIONS

a. Sailing instructions will be available at or before check-in on the day of the regatta.

7. RACING AREA

a. The race area will be as close to the marina as conditions permit.

8. COURSES

a. The courses to be sailing may include triangle and windward-leeward courses, as described in the sailing instructions.

9. PENALTY SYSTEM

a. Appendix T1, T2 and T3 will apply as described in the sailing instructions.

10. SCORING

a. The low point scoring system of appendix A will apply.

b. There is a goal of five (5) races, but fewer or more races are possible. The completion of at least one (1) race will constitute a regatta. If four (4) or more races have been completed, a boat’s series score will be the total of her race scores excluding her worst score.

11. PRIZES

a. Prizes will be awarded for the top 10 finishers (or fewer if there are not 10 competitors).

12. DISCLAIMER of LIABILITY

Sailing has an inherent risk of damage and injury. Competitors in these events participate entirely at their own risk. See Racing Rule 4.

13.  DECISION TO RACE

The race organizers (organizing authority, race committee, protest committee, host club, sponsors, volunteers or any other organization or official) will not be responsible for damage to any boat or other property or injury to any competitor, including death, sustained as a result of participation in this event. By participating in this event, and in accordance with Section 7-6-9 of the General Laws of Rhode Island, each competitor agrees to release the race organizers from any and all liability associated with such competitor’s participation in the event to the fullest extent permitted by law.

14.  ADDITIONAL INFORMATION

Edgewood Sailing School is the organizing authority for this regatta. Edgewood Yacht Club is the host location.

Competitors, coaches and parents are reminded that Narragansett Bay contains restricted channels. Sailing vessels do NOT have right-of-way over vessels under power that may be restricted in their ability to maneuver. Participation in this regatta does NOT provide standing over vessels that have right-of-way.

We may have limited hulls available if you cannot or do not want to bring your own—please contact us.

Light snacks will be available. We will try to keep the races close to the marina for good dockside viewing. This is a great chance to invite family members & friends to spectate, and to enjoy a relaxing time on the river.

15.  WAIVER OF LIABILITY AND CONSENT TO MEDICAL TREATMENT

This document relates to participation in Edgewood Sailing School (“ESS”) programs and activities, including without limitation instruction and other guidance provided by ESS and its instructors and other representatives, whether at facilities owned by Edgewood Yacht Club, Inc. (“EYC”) or otherwise, and whether on land, on docks, in the water, or on or in connection with vessels owned by Edgewood Parties (defined below), on any Owned Vessels (defined below), or on or in connection with any other vessels, vehicles, property, or equipment (collectively, the “Edgewood Activities”).

THIS WAIVER AND RELEASE IS INTENDED TO RELEASE AND DISCHARGE EACH OF THE EDGEWOOD PARTIES (DEFINED BELOW) FROM ANY AND ALL LIABILITY, RESPONSIBILITY, AND OBLIGATION IN ANY WAY ARISING OUT OF, RELATING TO, OR CONNECTED WITH THE PARTICIPANT’S PARTICIPATION IN EDGEWOOD ACTIVITIES, EVEN IF THAT LIABILITY, RESPONSIBILITY, OR OBLIGATION ARISES OUT OF NEGLIGENCE OR OTHER ACT, OMISSION, OR FAILURE OF, BY, OR ON THE PART OF ANY EDGEWOOD PARTY OR OUT OF ANY DEFECT IN ANY PROPERTY OR FACILITY OF ANY OF THE EDGEWOOD PARTIES.

A. Waiver, Release, and Indemnification.  By signing below, the Participant (and/or his or her parent or authorized guardian, as applicable), on his or her own behalf and on behalf of all of his or her executors, heirs, administrators, conservators, parents, next-of-kin, and estate, and their respective representatives, successors, and assigns (the Participant and such other parties collectively, the “Participant Parties”), acknowledges and agrees as follows:

(i) that boating is an activity that has an inherent risk of damage and injury to person and property associated with it, and that such damage and injury or the nature, scope, and extent thereof may not be known, foreseeable, or avoidable, and may arise from natural causes such as wind, rain and extreme weather conditions, may arise due to the actions of other boaters or sailors, may result from equipment failure or from defects in the condition of the marina from which sailing activities take place and may also result from mistakes made by others,

(ii) that the Participant is participating in Edgewood Activities at his or her own risk,

(iii) that neither ESS nor any of its instructors, employees, agents, representatives, volunteers, Participants, officials, officers, or directors, nor EYC nor any of its employees, agents, representatives, members, volunteers, officials, officers, or governors (collectively the “Edgewood Parties”) is or will be liable, responsible, or obligated for any claims, demands, suits, actions, costs, expenses, losses, injuries, disability, death, or damages to any of the Participant Parties, or to any other person, or for any claims, demands, suits, actions, costs, expenses, losses, or damages to any vessel (including any Participant Vessel, as defined below) or to any real or personal property, in each case in any way arising out of, relating to, or connected with (i) the Participant’s participation (and to any Participant Vessel’s participation) in the Edgewood Activities or (ii) any other use or occupancy of any of the premises, facilities, properties, or equipment of any of the Edgewood Parties by the Participant or any Participant Vessel, in each case even if the claims, demands, suits, actions, costs, expenses, losses, injuries, disability, death, or damages are caused in whole or in any part by any of the Edgewood Parties or by a defect in any of the premises, facilities, properties, or equipment of the Edgewood Parties (collectively, the “Potential Claims”),

(iv) that the Participant and the Participant Parties waive, release, and discharge all Potential Claims and will indemnify and defend the Edgewood Parties and hold them harmless from all Potential Claims, and

(v) that the Participant and the Participant Parties waive and release any right of subrogation that any insurer of the Participant Parties or of any Participant Vessel may have against any of the Edgewood Parties on account of Potential Claims or any payment or satisfaction by such insurer of Potential Claims.

B. Participant Vessels.  By signing below, if at any time the Participant brings to ESS or EYC or uses in any Edgewood Activities any vessel not owned by ESS (a “Participant Vessel”), the Participant (and/or his or her parent or authorized guardian, as applicable) represents and warrants that (a) he or she has all liability and casualty insurance for the Participant and for the Participant Vessel that any Participant Parties may find necessary and appropriate, and that the Participant Parties do not intend to rely on any of the Edgewood Parties to provide or maintain any insurance coverage, and that none of the Participant Parties shall make any claim, and hereby waive any claim, against any Edgewood Parties and against any insurers of or insurance policies held by any of the Edgewood Parties, in connection with any loss or damage to, by, or in connection with the Participant Vessel, whether or not any of the Edgewood Parties are in command or control of, or otherwise participating in or supervising or instructing the operation of, the Participant Vessel, and (b) that he or she has taken all necessary steps to ensure that himself or herself, his or her crew and passengers, and the Participant Vessel are adequately prepared for all possible contingencies, including appropriate safety equipment as may be required by law or that a prudent seaman would consider advisable.

C. Consent to Medical Treatment.  By signing below, the Participant (and/or his or her parent or authorized guardian, as applicable) authorizes staff of ESS and/or EYC to provide medical treatment to the Participant in the event of a medical emergency, provided that the provision of such treatment shall be in the discretion of such staff and the provision of such treatment or any failure to provide such treatment shall be subject to the foregoing provisions of this section 15.

The Organizing Authority for the 2018 Optimist Invitational Regatta will be Edgewood Sailing School.

1. RULES

1.1 The regatta will be governed by the rules as defined in The Racing Rules of Sailing (RRS) for 2017-2020. US Sailing prescriptions to rules 60, 63.2 and 63.4 will not apply.

2. PERSONAL FLOTATION

2.1 Competitors shall wear USCG approved Type III personal flotation at all times while on the water.

3. NOTICES TO COMPETITORS

3.1 Notices to competitors will be posted on the official notice board located at the registration table.

4. CHANGES TO SAILING INSTRUCTIONS

4.1 Any changes to the sailing instructions will be posted before 1200 on the day of the Regatta.

5. SIGNALS MADE ASHORE

5.1 Signals made ashore will be announced to competitors from the registration table.

6. SCHEDULE OF RACES

7. CLASS FLAGS

7.1  White flag with a blue Optimist class symbol.

8. RACING AREAS

8.1 The racing area will be as close to the marina as conditions permit.

9. COURSES

9.1 Triangle and windward-leeward courses (either once or twice around) will be selected. The race committee may move marks to maintain course configuration without a signal. The Race Committee (RC) will announce the course verbally and/or display numbers on white placards.

10. MARKS

10.1 Marks for course will be colored (generally orange/red/yellow/white) balls, cylinders, and/or tetrahedrons or may be government marks or other indications as announced.

11. START & FINISH

11.1 Starts will be signaled in accordance with the Appendix S (Whistle Start) system, with the warning given 3 minutes before the start. The start/finish line may use a committee boat OR the marina at one end, and an orange/red/white float for the pin.

12. TIME LIMIT

12.1 Boats whose places have been established may be finished by the Race Committee in order to expedite the next start.

13. PROTESTS & PENALTIES

13.1 Protesting boats shall inform the Race Committee of the boat being protested immediately after finishing. In accordance with Optimist Class rules, a protest flag must be flown by the protesting yacht. This instruction amends RRS 61.1(a). Protests may be filed at the registration table within one half hour of the last boat’s finish. Appendix T1, T2 and T3 will apply as described in the sailing instructions.

14. SCORING

14.1 The completion of at least one (1) race will constitute a regatta. The low-point scoring system of Appendix A will apply, except that a boat’s series score shall be the total of all her scores when fewer than four (4) races have been sailed. In the event of four or more (4) races, her lowest score will be dropped. One or more races will constitute a regatta.

15. SAFETY REGULATIONS

15.1 A boat that retires from a race shall notify the race committee as soon as possible.

16. TROPHIES

16.1 Trophies will be awarded to the top 10 finishers, if there are 10 or more participants.

17. DISCLAIMER OF LIABILITY

 

17.1 Participants in this event compete entirely at their own risk. See Rule 4, Decision to Race. The organizing authority will not accept any liability for material damage or personal injury sustained in conjunction with or prior to, during, or after the regatta. All participants must have submitted a properly executed waiver of liability and consent to medical treatment in the form attached to the Notice of Race.
